These terms govern your use of dalmatianhomes.com, the Dalmatian Voice mobile and desktop apps, and any text or rich messaging conversations with our licensed Michigan brokerage. By using the site or replying to one of our messages, you accept these terms.

Who we are

Dalmatian Real Estate LLC is an independent real estate brokerage licensed in the State of Michigan. The site, apps, and messaging service are operated by the brokerage at the contact details below.

Eligibility

You must be at least 18 years old and able to enter into a legally binding contract under Michigan law to use our services. By using the site, apps, or messaging service, you represent that you meet these requirements.

Real estate services and the agency relationship

Information on this site is for general informational purposes. Browsing the site, submitting a contact form, or exchanging messages with us does not by itself create a buyer-agency, seller-agency, or any other fiduciary relationship. A formal agency relationship is created only when you and a licensed Dalmatian agent sign a written agency agreement that complies with Michigan’s Occupational Code.

Until that agreement is signed, any agent who communicates with you is presumed to represent the seller or the listing brokerage unless we tell you otherwise in writing, in compliance with the Michigan agency-disclosure requirements.

Listing data and the MLS

Property data shown on this site, including photos, prices, square footage, and lot details, is supplied by FlexMLS, MichRIC, and the participating brokerages whose listings appear in those feeds. The data is believed to be accurate but is not guaranteed. Always verify with the listing agent and an inspection of the property before relying on it. Listings shown may have already gone under contract or sold; the feed may lag.

SMS, MMS, and RCS messaging terms

If you give us your mobile number on a contact form, listing-inquiry form, or by replying to one of our messages, you consent to receive text-based messages from Dalmatian Real Estate LLC. These may be standard SMS, MMS, or rich-communication-services (RCS) messages.

• What we’ll send: appointment confirmations, listing updates you asked about, transaction status, signature requests, and replies from our agents or our automated assistant. We do not send unsolicited marketing texts.
• How often: message frequency varies by your transaction. A typical buyer or seller in active escrow may receive several messages a week.
• Carrier costs: message and data rates may apply. We do not charge for messaging; your wireless carrier may.
• Stopping messages: reply STOP at any time and we will stop messaging that number. You can also email info@dalmatianhomes.com with the number to remove.
• Help: reply HELP at any time and you will receive contact information for our team.
• Supported carriers: we deliver via Telnyx LLC. Most major U.S. carriers are supported, including AT&T, T-Mobile, and Verizon. Carriers are not liable for delayed or undelivered messages.
• Mobile information sharing: we do not sell or share your mobile number with third parties for their marketing purposes. We share it only with service providers that help us deliver the messages (for example, Telnyx as our messaging carrier and the cloud and storage providers that house our customer-relationship system) and only as needed to operate the service. Consent to receive messages is not a condition of buying or selling a home with us. If you do not want to receive texts, tell your agent and we will work with you by phone or email.

Acceptable use

• Don’t use the site or messaging service to send unlawful, harassing, or fraudulent content.
• Don’t scrape, copy, or republish our listing displays beyond fair-use search; the underlying MLS data is licensed and protected.
• Don’t attempt to break, probe, or reverse-engineer the site, our APIs, or the Dalmatian Voice apps.
• Don’t impersonate a Dalmatian agent or another person.

Submitted information

When you fill in a contact form, agent application, pricing-strategy request, or send us a message, you confirm that the information is accurate and that you have the right to share it. We use that information to respond and provide the service you asked for, in line with our Privacy Policy.

Third-party links and services

The site links to third-party tools and resources, including Google Maps, FlexMLS, Zillow, mortgage calculators, and Microsoft 365 surfaces. We do not control those third parties and we are not responsible for their content, terms, or privacy practices.

Not investment advice

Dalmatian Real Estate is a Michigan real estate brokerage. We are not your financial advisor, attorney, accountant, or tax professional. Anything on this site or in our messages about market trends, financing, valuation, or returns is general information based on our experience as a brokerage. It is not investment, legal, tax, or accounting advice. Before you act, consult a licensed professional in the relevant field.

Disclaimer of warranties

The site, the apps, and the messaging service are provided on an “as is” and “as available” basis. We do not warrant that the site will be error-free, uninterrupted, secure, or that any information will be accurate or current. To the maximum extent allowed by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent allowed by law, Dalmatian Real Estate LLC and its agents and contractors are not liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the site, the apps, or the messaging service, including lost profits, lost data, or missed opportunities. Our total liability for any claim arising out of these terms is limited to the greater of one hundred dollars ($100) or the fees you have paid us in the twelve months before the claim. This limitation does not apply where prohibited by law.

Indemnification

You agree to indemnify and hold harmless Dalmatian Real Estate LLC and its agents from any third-party claim arising out of your misuse of the site, your violation of these terms, or your violation of someone else’s rights.

Governing law and venue

These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Ottawa County, Michigan, and you consent to that venue and jurisdiction.

Changes to these terms

We may revise these terms from time to time. The “Last updated” date above tells you when. Your continued use of the site, apps, or messaging service after a change means you accept the revised terms.
